FOR IMMEDIATE RELEASE

Rep. Pamela Carter and Rep. Matt Gress Vote to Fight for Arizona’s Water Security

STATE CAPITOL, PHOENIX – Legislative District 4 Representatives Pamela Carter and Matt Gress today announced their strong vote in support of HB 2116, legislation that strengthens Arizona’s ability to defend its rights to the Colorado River by increasing the Colorado River Litigation Fund by $1,000,000.

HB 2116 passed the Arizona House of Representatives on a 56 to 0 vote after advancing with near-unanimous support through the House Natural Resources, Energy and Water Committee and the Appropriations Committee. The bill now heads to the Arizona Senate.

As negotiations over the future of the Colorado River continue, cities such as Phoenix and Scottsdale remain heavily dependent on water delivered through the Central Arizona Project. Officials from Upper Basin states have openly stated they want to see CAP deliveries cut before accepting reductions themselves, despite their legal obligation under the 1922 Colorado River Compact to deliver minimum flows to Lower Basin states like Arizona.

“We must ensure a safe and reliable water supply for our residents,” said Representative Pamela Carter. “If other states refuse to honor the Compact, we have to be ready to defend our rights in court. HB 2116 ensures Arizona is not caught flat-footed if negotiations fail and litigation becomes unavoidable. I voted yes to protect our water supply, families, jobs, and future.”

The Arizona Legislature created the Colorado River Litigation Fund in 2025 to prepare for potential court action related to the state’s apportionment of Colorado River water. Projections indicate Upper Basin states may fall short of their delivery obligations in the coming years. The $1,000,000 appropriation would be used only if legal action becomes necessary.

“No one wants to go to court over water, but ignoring the risk of litigation would be irresponsible,” said Representative Matt Gress. “This funding gives Arizona the ability to defend itself and its rights if the Governor fails to reach a fair agreement. When the water supply of millions of Arizonans and our state’s economy are on the line, every step we take in preparation matters.”
