STATE CAPITOL, PHOENIX – Legislation sponsored by State Representative Jeff Weninger, Chairman of the Arizona House Commerce Committee, to impose strict accountability and enforcement standards on alternative nicotine products was approved late Tuesday by the House Commerce Committee.

House Bill 4001 establishes clear regulatory standards for the sale and manufacture of alternative nicotine products in Arizona. The bill requires retail and manufacturing licenses, strict age verification, and enforceable safeguards aimed at preventing sales to minors. It also prohibits packaging and marketing practices that mimic toys, electronics, food, or youth-oriented branding, and imposes escalating penalties for repeat violations.

The legislation grants the Department of Liquor Licenses and Control authority to inspect, investigate, and enforce compliance. It requires manufacturers to obtain FDA authorization or operate in certified U.S. manufacturing facilities. Beginning January 1, 2028, consumable materials used in alternative nicotine products sold in Arizona must be entirely manufactured and assembled in the United States.

“As a small business owner, I believe in free markets, but free markets only work when everyone follows the rules,” Representative Weninger said. “Right now, bad actors are exploiting gaps in the law, marketing nicotine products like toys, skirting age checks, and pushing products that cannot be traced or verified. That must stop.”

“HB 4001 puts Arizona on the side of parents, public safety, and responsible businesses,” Representative Weninger continued. “If you sell nicotine in this state, you will verify age, follow the law, and stop targeting kids. If you manufacture these products, you will meet clear standards and stand behind what you sell. This bill protects minors and supports businesses that play by the rules.”

HB 4001 does not impose a tax or appropriation. The bill establishes annual, nontransferable licenses for retailers and manufacturers and authorizes reasonable fees to support enforcement and oversight.

The bill now advances to the full Arizona House of Representatives for consideration.
