STATE CAPITOL, PHOENIX – The Arizona House of Representatives today passed House Bill 4001, sponsored by State Representative Jeff Weninger, Chairman of the Arizona House Commerce Committee, to strengthen enforcement and accountability for alternative nicotine products sold in Arizona.

“Arizona should not tolerate a market where nicotine products are packaged to look like toys and sold with weak oversight,” Representative Weninger said. “This bill puts guardrails in place, holds bad actors accountable, and makes clear that if you are in this business, you are going to follow the law.”

HB 4001 sets clear standards for the manufacture and distribution of alternative nicotine products and strengthens protections against underage sales. The bill bans packaging and marketing that mimic toys, electronics, food, or other youth-oriented products, and it imposes escalating penalties for violations.

The legislation also requires alternative nicotine products sold in Arizona to meet federal manufacturing standards and strengthens supply chain oversight by requiring manufacturers and distributors to be licensed and comply with state law. Beginning January 1, 2028, consumable materials used in alternative nicotine products sold in Arizona must be entirely manufactured and assembled in the United States.

“HB 4001 backs responsible businesses and goes after the people who cut corners, ignore age limits, and target kids,” Representative Weninger added. “That is the right approach: protect minors, enforce the rules, and make sure products sold in Arizona meet standards the public can trust.”

HB 4001 gives the Department of Liquor Licenses and Control authority to inspect, investigate, and enforce compliance, including through compliance audits of licensed manufacturers. It also strengthens identification and age-verification requirements for retailers and establishes penalties for individuals and enterprises that unlawfully sell nicotine products to underage persons.

The bill now advances to the Arizona Senate for consideration.
