STATE CAPITOL, PHOENIX – Arizonans who lease a vehicle will no longer be left on the hook when a new car turns out to be a lemon. House Bill 2323, sponsored by State Representative Pamela Carter, is now law, closing a gap in Arizona statute that denied lessees the same warranty protections available to vehicle buyers.

Under prior law, a person who bought a defective vehicle could pursue relief under Arizona’s lemon law, while someone leasing that same vehicle could be stuck making payments on a car that kept failing. HB 2323 fixes that by expanding the definition of “consumer” to include a lessee of a motor vehicle.

HB 2323 was introduced after constituents shared stories of leased vehicles cycling in and out of repair shops with no clear recourse under Arizona law. The bill passed unanimously in both the House and Senate.

“I brought this bill because I heard from Arizonans who were doing everything right and still got stuck with defective leased vehicles and no real path for relief,” Representative Carter said. “That is not how the law should work. HB 2323 makes a simple but important correction by making sure lessees are protected under Arizona’s lemon law too.”
